Dear Ms. Smith,
I refer to your correspondence of the 15th instance and wish to respond accordingly. I note from your correspondence that you inquire as to whom Mandate presently represent within the business, in this regard, I wish to advise whilst I am not in a position to share the names of the individual members for GDPR reasons, I can confirm we represent the vast majority of the Sales Team.
Furthermore, I note that you have asked that we outline the issues which are disputed and I do so as follows;

  • New Routes/Products
  • Loss of Earnings
  • Additional Workload
  • Alteration to Commission Structure

Finally with regard to your request for the undersigned to clarify my reference to a trade dispute, it should be first noted that the reference, in full was, as it is in the instant correspondence as follows; “Trade Dispute in Furtherance/Contemplation of New Routes/Products and Alteration to Commission Structure” As I’m sure you are aware the Industrial Relations Act 1990 defines a Trade Dispute as ; “Any dispute between employers and workers which is connected with the employment or non-employment, or the terms or conditions of, or affecting the employment of any person.” Accordingly for the purposes of the aforesaid act it is clear that a trade dispute presently exists between our members and the company. Please note that, should it be necessary to escalate matters further this will be done in cogent compliance with the aforesaid act and subsequent to a ballot of the members concerned.
Notwithstanding the foregoing, it is our preference to engage in responsible manner and find an amicable solution acceptable to all of the parties.
