We are writing to advise you that the Workplace Relations Commission (WRC) has been in contact with Mandate in relation to the impending hearings regarding the alleged failure of the Company/KMPG to adequately consult with your Union Representatives in relation to the redundancies and the failure to adequately provide information to the Union regarding same.
In an effort to expedite the resolution of these unresolved complaints, the Workplace Relations Commission will hear two test cases, which will be subject to a full hearing of the Adjudication Service to include written submissions by both parties and direct evidence etc., as determined by the WRC procedures. As all of the cases are identical in nature, the Adjudicator’s decision in both test cases will apply to the entirety of the cases referred into the WRC by Mandate Trade Union.
Please note we will consult with the former Shop Stewards group to select the test cases.
For those complainants who do not wish for Mandate Trade Union to process their complaints as outlined above you are required to confirm your instruction by email to debenhamswrcclaims@mandate.ie by close of business on Wednesday, February 8th 2022, otherwise we will assume you wish to proceed on the basis as outlined.
