Dear Penneys Member,
As per the contents of the 2016 Mandate Trade Union & Penneys Certainty of Earnings & Certainty of Costs Agreement, which you can view in full HERE, the Annual Band-Assimilation Process Application period is from mid-September to the first week of October (inclusive)
Members who believe they have worked above their current band of hours and wish to have this assessed, should pay particular attention to section 4.5 of the above referenced agreement, and should then submit an application for Annual Review of Hours Form (available HERE) to the P&C Manager in your store. Section 4.5 reads:
“Annual Review of Hours – Effective from September 2015 employees who genuinely feel they have worked above their band for the agreed assimilation period may approach store management once annually during weeks 1, 2, 3 (mid Sept-early Oct) to request the Company to review their average hours for the previous financial year as per the reference period outlined in Clause 4. 1. After the averaging exercise has been completed, the steps contained in section 5 shall apply”.
Once this process has been completed, please note the steps as set out in Section 5.0 of the same agreement, which reads:
“Once assimilation has occurred, the hour’s range in which the employee falls becomes their new minimum hours range save for the seven week trough period of January (except wk 17) and February (Periods 5 & 6) where it is agreed that the employee will be guaranteed hours that fall no lower than the bottom of that range, below which they currently sit (save for employees in Range A). E.g If Mary sits in range C, for the trough months of January and February (Periods 5 & 6) the company may roster Mary in Range B.”
